Terms and Conditions for the Sale of Tickets to the LIFMAT
2023 Educational Event, organized by Magicware, Ltd
1. Introductory Provisions
1. Magicware,
Ltd., with its registered office at Krohova 2212/75, 160 00 Prague 6, ID number
62576836, tax ID CZ62576836, registered in the Commercial Register kept by the
Municipal Court in Prague, Section C, Insert 32719, represented by Ing. Tomáš
Novosad, the company's representative, hereinafter referred to as the
"Company," issues these Terms and Conditions. The Terms and
Conditions govern the sale of tickets to the LIFMAT 2023 educational
conference, taking place on October 24th and 25th, 2023 in Prague.
2. Ticket
Sales
1. The
Company invites through its website www.lifmat.cz the submission of proposals
for the conclusion of a contract for the purchase of tickets for the specified
educational event. The provisions of Section 1732 of Act No. 89/2012 Coll., the
Civil Code, as amended by later regulations (hereinafter referred to as the
"Civil Code"), shall not apply.
2. To place an order for tickets, it is necessary
to provide and submit all the data required for the ticket purchase.
3. The
ticket purchaser (hereinafter referred to as the "Proposer") submits
an order made through the Company's website interface, accessible from the
www.lifmat.cz website, proposing the conclusion of a contract for the purchase
of tickets for the specified educational event (hereinafter also referred to as
the "Order"). By accepting the Order, the Company reserves the ticket
for the Proposer.
4. By submitting the Order, the Proposer agrees to
these Terms and Conditions and the Privacy Policy. These Terms and Conditions
constitute an integral part of the contract, pursuant to Section 1751 (1) of
the Civil Code.
5. The purchase agreement for the sale of tickets
is concluded upon acceptance of the ticket Order by the Company, which is
confirmed by sending an email confirmation from the Company to the email
address provided by the Proposer in the ticket Order.
6. Due to
the nature of the educational event and the ticket price, the Proposer is
considered a professional and not a consumer within the meaning of Section 419
of the Civil Code. Therefore, the consumer protection provisions, in particular
Section 1810 and subsequent sections of the Civil Code, do not apply.
7. The
payment of the ticket purchase price can be made online by credit card.
8. The
Company will send the ticket to the Proposer along with instructions for
registration in the conference application via email. In this application, the
Proposer will have their valid ticket.
9. The
ticket is bound to a specific participant, an individual person, indicated by
the Proposer in the ticket Order ("Participant"). The Participant can
be changed upon request - a request to change the Participant for paid tickets
can be submitted free of charge no later than October 20th, 2023.

2. Ticket
prices for the Public Conference and LIFMAT Market

3. In
case the Participant is unable to attend the LIFMAT 2023 event, the paid amount
for the tickets will not be refunded, and only a change of the Participant
according to Article II, Section 9 of these Terms and Conditions is possible.
4. In the
event of cancellation of the event, the Proposer is entitled to a full refund
of the ticket price.
5. Article
III, Section 3 shall not apply if circumstances occur that are beyond the
control of either party (the Company or CUBEX Centrum Praha as the venue), such
as force majeure, war, terrorist attack, government measures, disaster,
strikes, civil unrest, transportation restrictions, and if, as a result of
these circumstances, it becomes unlawful or impossible for the LIFMAT
conference to take place on October 24th and 25th, 2023. In such a case, the
Company will promptly arrange an alternative date for the conference, and
tickets will not be refunded. The Company will announce the nearest possible
alternative date for the LIFMAT 2023 conference. This provision also applies
specifically in connection with the occurrence of COVID-19, characterized as a
pandemic by the World Health Organization on March 11th, 2020: if a country,
state, or province, where the venue is located (i.e., Prague), or the country,
state(s), or province(s) from which the majority of participants are traveling,
issue regulations, recommendations, notices, or warnings (hereinafter
collectively referred to as "Notices") advising travelers not to travel
to the city where the venue is located, avoid gatherings of the size intended
for the LIFMAT 2023 conference or, due to the COVID-19 pandemic, remain at the
place/stay at home. In this case as well, the Company will not refund the
tickets and will announce an alternative date for the LIFMAT 2023 conference.
4. PERSONAL
DATA
1. The
Privacy Policy, which is part of these terms, applies to customers and
participants of the educational event who are individuals.
5. EFFECTIVENESS
OF TERMS AND CONDITIONS
1. These
Terms and Conditions come into effect on July 1st, 2023, and apply to the
purchase of tickets for LIFMAT 2023. Subsequently, the conditions may be
replaced by a new version. The ineffectiveness of the conditions does not
affect the effectiveness of the Privacy Policy, which remains effective
independently.
2. These
Terms and Conditions are drafted in the Czech language.
5. FINAL
PROVISIONS
1. The
obligations of the Company towards Proposers and interested parties, as well as
any claims by Proposers or interested parties against the Company, become
time-barred after one (in words: one) year.
2. The
Company reserves the right to change the content of these Terms and Conditions,
especially the ticket price, at any time.
3. If any
provision of the Terms and Conditions is invalid or ineffective, or if it
becomes so, a provision shall be applied that most closely approximates the
sense of the invalid provision. The invalidity or ineffectiveness of one
provision does not affect the validity of the other provisions.
4. For
relationships with an international element, Czech law is agreed upon as the
governing law for disputes arising in connection with these Terms and
Conditions and contractual relationships concluded based on them. The courts
competent to decide disputes between the contracting parties are Czech courts.
